Terms and Conditions — OptimumEffective Date: October 23, 2025These Terms and Conditions (“Terms”) govern your access to and use of the Optimum mobile application and related services (collectively, the “App”), operated by Optimum Pty Ltd (“Optimum,” “we,” “our,” or “us”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the App immediately.1. Eligibility and Account UseYou must be at least 18 years of age to use Optimum. By using the App, you represent that you have the legal capacity to enter into a binding agreement under applicable law.Optimum is provided solely for personal and lawful use. You agree not to use the App in any manner that violates laws, regulations, or third-party rights.2. Service OverviewOptimum provides a non-custodial digital wallet and QR-based payment interface that enables users to interact with supported cryptocurrencies and blockchain networks.We do not hold, manage, or have access to user funds, private keys, or seed phrases.
All transactions are executed directly by users through their own wallets and are processed on decentralized blockchain networks.3. User ResponsibilitiesYou are solely responsible for:Maintaining control and security of your wallet credentials, recovery phrases, and devices.Ensuring all transaction details, including wallet addresses, are accurate.Complying with all applicable laws and regulations within your jurisdiction.Once initiated, blockchain transactions are irreversible. Optimum cannot cancel, refund, or retrieve digital assets.4. Prohibited ConductYou agree not to:Use Optimum for unlawful, fraudulent, or malicious activities.Interfere with the integrity, security, or performance of the App.Copy, decompile, or reverse-engineer any portion of the App.Use the App to transmit unauthorized or harmful content.Violation of these Terms may result in immediate suspension or termination of your access to the App.5. Intellectual PropertyAll content, branding, design elements, and software associated with Optimum are the intellectual property of Optimum Pty Ltd.You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for personal purposes only. No ownership rights are transferred by downloading or using Optimum.6. Limitation of LiabilityTo the maximum extent permitted by law:The App is provided on an “as is” and “as available” basis without warranties of any kind.Optimum makes no representations regarding the reliability, accuracy, or availability of blockchain networks or third-party services.Optimum, its directors, employees, and affiliates shall not be liable for any indirect, incidental, or consequential losses arising from the use of the App, including loss of funds, data, or profits.You acknowledge that all cryptocurrency transactions carry inherent risks, including volatility and potential loss of value.7. Third-Party ServicesOptimum may interact with external blockchain networks or service providers. We do not control or assume responsibility for these third-party systems or their data policies.
Your interactions with any third-party service are entirely at your own discretion and risk.8. TerminationOptimum reserves the right to suspend or terminate access to the App at any time without notice if you violate these Terms or engage in conduct deemed harmful to the platform or its users.Upon termination, all rights granted to you under these Terms shall immediately cease.9. Updates to These TermsWe may revise or update these Terms periodically to reflect product developments, legal requirements, or policy changes.
All modifications will be published within the App with an updated “Effective Date.” Continued use of Optimum after such updates constitutes your acceptance of the revised Terms.10. Governing LawThese Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict-of-law principles.
